While it may sound hard to believe, it is entirely possible that a personal injury lawyers fees turn out to be more than the client gets in the end. How this happens is as follows; a typical car accident claim with a bodily injury liability policy of $10,000.00, and the injured client has $5,000.00 in unpaid medical bills. If the lawyer takes his 1/3 fee the lawyer gets $3,333.33 and the client gets the remainder or about $1,666.67. For many personal injury clients this comes as quite a shock that the lawyer made more then they did on their case. Is this legal? Is this Ethical? Unfortunately the answer is yes, it is legal and ethical according to the Florida Bar. If you dont want this to happen to you, ask your lawyer if they will reduce their fees at the end of the case so that they dont make more than you. Ask them to give you this promise in writing at the start of the case. If the lawyer wont give you this promise in writing, they probably wont reduce their fees at the end and the above scenario could happen to you.

Although many attorneys will reduce their fees, I certainly don't find a refusal to reduce as unethical. If the attorney contracts for 1/3, he can get 1/3. If the plaintiff's medical bills take up most of the other 2/3, the plaintiff still gets what he bargained for.

It's true. You need to know what you're getting yourself into before you make a deal. It really does depend on the situation though. And let's face it, shouldn't the client be more concerned with paying off the medical bills rather than taking a cut for themselves?

It's real. You need to know what you're getting yourself into before you create a cope. It really does rely on the scenario though. And let's experience it, shouldn't the consumer be more worried with shelling out off the hospital expenses rather than getting a cut for themselves?

It may be legal but is not ethical. The victim should be entitled to as much as possible. My cousin was recently injured in a car accident. He sued for damages and won a nice amount of money. The money he won was to be paid to him on a monthly basis. Shortly after he ran into financial troubles. Luckily he was able to get a cash for structured settlement payment plan with a reliable company just in time.

It is definitely possible especially if the case requires much time from the injury lawyer. It is actually the opposing party who will be paying for the legal damages anyway.
